Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Aussie Toolkit website, the SWMS generator, and related services (together, the "Service"). The Service is operated by [your legal entity / your name] (ABN [your ABN]) ("Aussie Toolkit", "we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What the Service is — and what it is not

The Service is a tool that helps you create Safe Work Method Statements ("SWMS") and related work health and safety ("WHS") documents, using information you provide together with general content libraries and templates.

The Service does not provide legal, safety, engineering or WHS advice, and is not a substitute for it. It does not guarantee that any document you produce meets the requirements of any law, code of practice, regulator or principal contractor. You are solely responsible for:

  • ensuring any SWMS or document is accurate, complete, site-specific and compliant with the WHS laws of your jurisdiction;
  • reviewing, verifying, adapting and approving all content before you rely on or submit it;
  • your own WHS obligations and those of your business or PCBU; and
  • obtaining professional advice where appropriate.

Compliance requirements vary by State and Territory and change over time. You must confirm requirements with your relevant regulator (for example Safe Work Australia, SafeWork NSW or WorkSafe Victoria).

2. Eligibility & your account

You must be at least 18 years old and use the Service for business or professional purposes. You are responsible for keeping your login credentials secure and for all activity under your account. Provide accurate information and keep it up to date. Tell us promptly of any unauthorised use.

3. Acceptable use

You agree not to: use the Service unlawfully or for any unlawful purpose; resell, sub-licence, share or commercially exploit access to the Service except as expressly allowed; copy, scrape, reverse engineer or attempt to extract our source code, content libraries or templates; interfere with or disrupt the Service; or upload unlawful, infringing or harmful content.

4. Plans, payments & billing

You can build a SWMS for free. Exporting, signing or saving certain documents requires a paid entitlement: pay-per-export credits, a Pro subscription, or a Founder licence. Prices are shown at the point of purchase and are in Australian dollars unless stated.

  • Payments are processed by our payment provider (Stripe). We do not store your full card details.
  • Subscriptions renew automatically for successive periods until cancelled. You can cancel at any time through the billing portal; cancellation stops future renewals and you keep access until the end of your current paid period. Failed payments may suspend access.
  • Credits are one-off and (unless stated) do not expire; they are consumed when you export.
  • Price changes to subscriptions will be notified in advance and apply from your next renewal.

Refunds are governed by our Refund Policy and your rights under the Australian Consumer Law (see section 9).

5. Founder lifetime licence

A "Founder" or "lifetime" licence means access to the SWMS toolkit and its SWMS updates for as long as Aussie Toolkit continues to operate and offer the Service — it does not mean your personal lifetime, and it ends if the Service is discontinued. It is personal to your account and non-transferable. New premium add-ons or modules (for example AI-assisted drafting, which carries its own running costs) may be offered as optional paid extras, including to Founder licence holders.

6. Your content & intellectual property

You retain ownership of the documents, project details and data you create or input ("Your Content"). You grant us a non-exclusive licence to host, store, process and display Your Content for the purpose of providing the Service to you. You are responsible for Your Content and for having the right to use it.

If you add other people's details (for example workers' names or signatures) to a document, you are responsible for collecting and handling that information lawfully, including obtaining any necessary consent. See our Privacy Policy.

We (and our licensors) own the Service, including the software, content libraries, templates, designs and the Aussie Toolkit brand. These Terms do not transfer any of our intellectual property to you.

7. Third-party services

The Service relies on third-party providers (including for authentication, database hosting, payments and email). Your use may also be subject to their terms. We are not responsible for third-party services we do not control.

8. Availability & changes

We aim to keep the Service available but do not guarantee it will be uninterrupted, error-free or secure. We may modify, suspend or discontinue features at any time. To the extent permitted by law, the Service is provided "as is".

9. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law ("ACL") or any other law that cannot lawfully be excluded. Where we are permitted to limit our liability for a failure to comply with a consumer guarantee, our liability is limited (at our option) to re-supplying the relevant services or paying the cost of having them re-supplied.

10. Limitation of liability

Subject to section 9, and to the maximum extent permitted by law:

  • we are not liable for any indirect, special, incidental or consequential loss, or for loss of profit, revenue, data, goodwill or anticipated savings;
  • we are not liable for any loss, penalty, fine, injury, incident or claim arising from your reliance on, or use of, any SWMS or document created with the Service, or from your WHS compliance (or non-compliance); and
  • our total aggregate liability arising out of or in connection with the Service is limited to the greater of (a) the total fees you paid us in the 12 months before the relevant claim, or (b) AUD $100.

11. Indemnity

To the extent permitted by law, you indemnify us against claims, losses and costs (including reasonable legal costs) arising from your breach of these Terms, your use of the Service, Your Content, or your WHS obligations.

12. Suspension & termination

We may suspend or terminate your access if you breach these Terms or to protect the Service or other users. You may stop using the Service at any time. On termination, your right to use the Service ends; sections that by their nature should survive (including sections 6, 9, 10 and 11) continue to apply.

13. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will take reasonable steps to notify you. Your continued use after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of [your State/Territory], Australia, and you submit to the non-exclusive jurisdiction of its courts.
